Abstract
The record of the Supreme Court of the United States shows that, almost from the beginning of its existence, the Court has come under criticism for its decisions. It shall be the purpose of this work to examine criticism of the Court and its decisions in the period from 1935 to 1965. This study of the Court includes criticism selected with the object in mind of presenting nearly all of the various points of view critical of Court decisions in the years from 1935 to 1965. As will be readily apparent, Part I includes the criticism offered by the more scholarly journals and by professional people, namely, political scientists, historians., and lawyers. In the more recent period the selection of criticism of the Court involves primarily members of Congress and journalists. Because of the short time interval that separates the events of Parts II and III from the present., literature on the subject does not yet include many opinions from professional people such as those cited in Part I. A selective historiographical study of such a recent period necessarily presents problems in evaluating and generalizing about the record of the Court. Nonetheless., an examination of criticism of the Court can prove to be of value in its own right. It is hoped that such an examination of opinions about the Supreme Court and its decisions over the past thirty years can be of use to historians of the future in evaluating the Court and drawing some long-range conclusions about its efforts. Let us look at the record.
