Abstract
Nowhere is the battle over sacred and secular waged with such intensity and frequency as in the schools of this country. It is, therefore, entirely fitting that a discussion of issues in education include the separation of Church and State. The ever increasing number of decisions handed down by the Supreme Court attest to the fact that the legal issues of separation of Church and State are multiple and complex. When dealing with these issues in a short paper, we must be clear on the issues being discussed. This paper shall focus on two main issues: the fact that "separation of Church and State" is often misleading; and whether or not the current tests being applied to Establishment Clause cases (known as the Lemon test) and Free Exercise cases are adequate.
