Abstract

In 47 years of Supreme Court jurisprudence defining and interpreting the Establishment Clause and the Free Exercise Clause, some questions have been answered, others have been toyed with, and those in turn have led to the situations from which new religious constitutional issues arise almost daily. This background paper focuses almost exclusively on Supreme Court cases from Everson forward. Naturally there have been significant religion cases decided in federal district and circuit courts as well as some interesting state court decisions; however, these will not be addressed here.
