Abstract
Iowa Code Chapter 26, known as the Iowa Construction Bidding Procedures Act, sets forth the process and procedures that governmental entities in Iowa must use to seek competitive bids and award the contract for a public improvement project. Governmental entity means, “the state, political subdivisions of the state (local governments), and public school corporations” (Iowa Code 2025a, I-909). Public improvement means “a building or construction work that is constructed under the control of a governmental entity” (Iowa Code 2025a, I-910). Chapter 26 requires governmental entities, including state agencies, cities, counties, public school districts, and community colleges to award the contract for a public improvement project to the lowest responsive, responsible bidder using the design-bid-build project delivery method, commonly known as “low bid.”
